Dad accused of shooting 13-year-old daughter’s alleged rapist has murder charge dropped after police make mistake

Aaron Spencer, a local sheriff candidate and army veteran, has been exonerated of murder charges after he fatally shot a man who was accused of sexually assaulting his teenage daughter. This decision came after a judge determined that law enforcement mishandled a crucial aspect of the case.

An Arkansas judge has dismissed the murder charges against an Army veteran and sheriff candidate who was alleged to have shot a man accused of sexually assaulting his teenage daughter.

Originally, Aaron Spencer faced second-degree murder charges for the shooting death of 67-year-old Michael Fosler in Lonoke County in October 2024.

Court documents indicate that Judge Ralph Wilson Jr. dismissed the case on Thursday.

Prosecutors claimed that Spencer discovered Fosler alone with his teenage daughter in Fosler’s pickup truck late at night on October 8, 2024. Authorities reported that Spencer forced the truck off the road and subsequently called 911 to report the shooting.

The judge noted that law enforcement mishandled the dash-camera and SD card evidence from Spencer’s vehicle. Additionally, it was highlighted that dismissing a case is an extremely rare and significant action in any criminal trial.

“However, considering the overall circumstances and the unique, specific facts of this case, the Court finds that the conduct of law enforcement was so severe that dismissing this case is justified,” the judge stated.

Spencer’s attorneys contended that police lost the SD card, which might have held video evidence of the incident, and did not clarify when or how it went missing.

The judge concluded that “the loss or destruction of the internal SD memory card of the dash camera has significantly hindered the Defendant’s ability to mount a defense based on these arguments, thereby compromising his right to a fair trial,” as per court records.

According to Fox News, court documents indicated that Fosler had faced several sexual offense charges involving Spencer’s teenage daughter and was out on bail at the time of the deadly shooting.

Just a few months prior to this event, Spencer had celebrated a significant political achievement. In February, he secured the Republican primary for Lonoke County sheriff, defeating the sitting sheriff and vowing to implement change and reform within the county’s law enforcement.

“Through my own struggle for justice, I have witnessed the shortcomings in law enforcement and our circuit court,” Spencer stated in a campaign video. “I will not remain silent while others endure these same injustices.”

Spencer has confessed to shooting Fosler. However, despite acknowledging his involvement in the incident, he has pleaded not guilty to the murder charges against him.

The highly publicized case was set to be presented to a jury on June 22, as the circumstances surrounding the fatal encounter continued to capture public interest.

Spencer has never contested that he pulled the trigger. He admitted to fatally shooting Fosler but insisted that he is not guilty of murder.

As the case garnered significant attention, Spencer was getting ready to confront a jury trial scheduled for June 22. Spencer’s lawyer, Erin Cassinelli, expressed her gratitude for the court’s ruling.

“No member of this family should ever have to step into a courtroom again and experience this nightmare,” she expressed in a statement. “This father should never have faced charges for defending his child.”
